Terms & Conditions

By submitting a booking request with Portraits by Justin, you agree to the following terms and conditions. These terms are legally binding and are here to ensure a smooth, enjoyable, and professional experience for both you and your photographer.

1. Booking Process & Payment

All bookings must be submitted via the official Booking Form, available through the website or social media channels.
Clients must select their desired package, preferred date(s), and provide accurate contact information at the time of submission.
If your requested date and time are available, you will receive a confirmation email that includes payment instructions.
Your session is considered confirmed only once full payment has been received. No shoot date will be reserved without payment.

2. Cancellations & Refunds

Cancellations made by the client more than 72 hours in advance of the scheduled shoot are eligible for a full refund.
Cancellations made by the client less than 72 hours in advance of the scheduled shoot are eligible for a 50% refund or rescheduling.
No-shows or failure to arrive at the agreed location within 20 minutes of the scheduled time without prior communication will be considered a cancellation with no refund.
If I am forced to cancel a session due to personal emergency, illness, or circumstances beyond my control, clients will be offered the choice of a full refund, or a rescheduled session at no additional cost.

3. Rescheduling

If you need to reschedule, I will do my best to accommodate your request, but rescheduling is subject to availability. Rescheduling is free once per booking if made at least 24 hours in advance.
If weather conditions are poor or unsafe, I will reach out to reschedule or find an alternative solution.

4. Late Arrivals

Please arrive at the meeting point on time to make the most of your session.
If you are running late, please contact me as soon as possible.
Sessions will not be extended due to late arrival. If you are more than 20 minutes late without notice, the session may be considered cancelled and non-refundable.

5. Delivery of Photos

Final edited images will be delivered via a private Google Drive folder within 10 business days after the session.
The number of images delivered depends on the package selected.
Final images will be available for download through Google Drive for 30 days after delivery. Clients are responsible for downloading and backing up their files. After this period, I may remove the files from my active storage to free up space. I do not guarantee long-term backup of your images unless otherwise agreed upon in writing.

6. Usage Rights

I (Justin) retain full copyright and ownership of all images produced during the session.

Clients are granted a personal-use license. This allows you to:

Share images on social media or personal websites
Print images for personal use
Use images for holiday cards or non-commercial gifts

You may not:

Sell, license, or profit from the images in any way without prior written permission
Use the images for commercial purposes (e.g. product promotion, brand partnerships, or advertisements) without an extended commercial license

I reserve the right to use selected images for portfolio, website, social media, printed marketing materials, and other promotional purposes, unless the client specifically requests in writing (prior to the shoot) that their images remain private.

7. Client Conduct & Safety

I aim to provide a relaxed and enjoyable experience, but I reserve the right to end a session early if a client behaves in a way that is disrespectful, unsafe, or inappropriate.
Clients participate in photo sessions at their own risk.
I am not liable for any personal injury, property loss, or damage during the shoot.
Clients are responsible for their own safety, belongings, and punctuality throughout the session.
If children are involved in the session, they must be accompanied by a responsible adult at all times.

8. Communication

Official communication will be conducted via email. Instagram DMs and Facebook Messenger may be used for informal or initial contact, but all important details (booking confirmation, payment, and delivery) will be sent by email.
I aim to respond to all messages within 24 hours, but response times may vary during weekends or high season.

9. Data Protection & Privacy

By submitting the booking form, you agree to the collection and limited use of your personal data in accordance with Dutch privacy laws and GDPR (General Data Protection Regulation).

What data is collected:

Name
Email address
Booking details (date, time, session type, location)
Any personal notes or preferences shared via the form or email

How your data is used:

To process and confirm your booking
To communicate with you before and after the session
To deliver your photos via Google Drive
For basic internal recordkeeping

Your data will never be shared, sold, or used for third-party marketing. It will only be accessed by me (Justin), and stored securely within my Google Workspace account. Any sensitive data (like payment confirmation) will be treated with the highest level of confidentiality.

You can request that your data be deleted from my records at any time by contacting me directly at info@portraitsbyjustin.com.

10. Acceptance of Terms

By submitting the booking form and checking the box to confirm agreement, you acknowledge that you have read, understood, and accepted these Terms & Services.
These Terms & Services are governed by Dutch law. Any disputes arising from services provided by Portraits by Justin will be subject to the jurisdiction of the courts in the Netherlands.
